This Disclaimer governs the limits of liability and the nature of CredoVPN as provided by Dolphin LLC (ООО «Дельфин»), INN 6633019190, OGRN 1126633001153, Russian Federation, Yekaterinburg, hereinafter the “Contractor.”
This document applies together with the Public Offer, User Agreement, Service Usage Rules, Privacy Policy, Refund Policy, No-Logs Policy, Subscription Terms, and other CredoVPN documents.
By using credovpn.ru, Telegram bots, interfaces, access configurations, paying for a subscription, activating a trial, or otherwise using CredoVPN, the user confirms they have read this Disclaimer, understand it, and accept its terms.
1. General provisions
1.1. CredoVPN is provided to the user digitally, remotely over the Internet, without delivery of a physical medium.
1.2. This document sets expectations about the service and explains circumstances outside the Contractor’s control.
1.3. Use of the service is voluntary, at the user’s own risk, and subject to the limits stated here and in other official service documents.
1.4. If the user does not agree with this Disclaimer, they must stop using the service.
2. “As is” and “as available”
2.1. CredoVPN is provided on an “as is” and “as available” basis.
2.2. The Contractor does not warrant that:
- the service will run continuously without interruption;
- the service will run without technical errors, delays, or temporary limits;
- all servers, locations, features, and routes will be available at all times;
- the service will perform equally on all devices, networks, and countries;
- the service will be compatible with every OS version, device, network, program, and user configuration.
2.3. The user understands and accepts that a digital network service inherently depends on many external technical factors that cannot be fully controlled by the Contractor.
3. Device, network, and ISP limits
3.1. Service operation may depend on:
- the user’s device;
- operating system;
- app version;
- internet connectivity;
- router;
- local network;
- corporate network;
- ISP;
- roaming limits;
- antivirus software;
- firewalls;
- device system settings;
- other programs and services installed for the user.
3.2. The Contractor is not liable for inability to use the service caused by:
- poor quality of the user’s internet connection;
- blocks or limits by the ISP;
- limits by the mobile carrier;
- router, device, or local network settings;
- conflicts with installed software, VPN clients, firewalls, antivirus, or other programs;
- errors due to outdated, modified, or non-standard user software.
3.3. The user is solely responsible for technical suitability of their device, network, and software environment for the service.
4. Geography and jurisdiction
4.1. The Contractor does not warrant that the service will be available, stable, or equally functional:
- in all countries;
- in all regions;
- in all jurisdictions;
- with all carriers;
- on all network types.
4.2. In some countries, regions, networks, or with some carriers, the service may be difficult, limited, slowed, or impossible because of:
- local rules and restrictions;
- technical filtering;
- routing specifics;
- blocks and restrictions by third parties;
- technical policies of data centers, providers, and carriers.
4.3. The user independently assesses whether use is permissible in their jurisdiction and is responsible for complying with applicable law where they are located.
5. Speed, stability, and quality
5.1. The Contractor does not warrant any specific speed, ping, route stability, or unchanged quality of access at all times.
5.2. Actual speed may depend on:
- current network load;
- selected server;
- distance to the server;
- state of the user’s internet channel;
- provider-imposed limits;
- load on external internet resources;
- specifics of the user’s device.
5.3. Lower speed, unstable channel, higher latency, or brief outages do not by themselves mean the service is faulty.
6. Supported application
6.1. Technical support for CredoVPN is provided only for use through the WireGuard application.
6.2. If the user relies on third-party apps, unsupported clients, alternative VPN setups, or custom configurations outside the supported scenario, the Contractor:
- does not warrant correct service operation in that mode;
- does not warrant that the issue can be diagnosed;
- is not liable for errors caused by such apps;
- may recommend contacting the relevant app vendor.
6.3. Unsupported apps are used at the user’s own risk.
7. Third parties
7.1. The Contractor is not liable for actions, inaction, decisions, or technical limits of:
- ISPs;
- mobile carriers;
- data centers;
- payment systems;
- banks;
- crypto processors;
- DNS operators;
- third-party software vendors;
- owners of external internet resources;
- other third parties.
7.2. The Contractor is not responsible for:
- unavailability of particular sites or services not owned by the Contractor;
- restricted access to external resources;
- technical errors on third-party platforms or apps;
- changes to third-party service rules;
- actions of administrators of external networks and resources.
8. Maintenance and service changes
8.1. The Contractor may at any time perform:
- preventive maintenance;
- emergency work;
- technical updates;
- changes to server infrastructure;
- route changes;
- replacement, shutdown, or addition of servers;
- updates to interfaces and service mechanics.
8.2. During such work, the service may be fully or partly limited.
8.3. The Contractor is not liable for temporary limits required to maintain, update, repair, protect, or change service infrastructure.
9. User conduct
9.1. The user uses the service voluntarily and independently decides how, for what purposes, and under what conditions to use it.
9.2. The Contractor is not liable for consequences of use that violates:
- law;
- the Public Offer;
- the User Agreement;
- the Service Usage Rules;
- other official service documents.
9.3. The user is solely responsible for:
- lawfulness of their purposes;
- compliance with limits of their jurisdiction;
- security of their device;
- correctness of their own setup and connection actions;
- safekeeping of configurations and access credentials.
10. Payments and financial limits
10.1. The Contractor is not liable for:
- user payment errors;
- wrong currency selection;
- wrong network for a digital asset transfer;
- transfers to a wrong address;
- fees of payment intermediaries and blockchain networks;
- processing delays by banks, acquirers, or other intermediaries;
- refusal by a payment intermediary to process a transaction.
10.2. The Contractor does not warrant availability of every specific payment method at all times.
10.3. The user bears the risk of errors in payment details, network, amount, currency, or other payment parameters.
11. Support and guidance
11.1. CredoVPN support assists within what is reasonably related to:
- connecting to the service;
- using WireGuard;
- access, subscription, payment, and refunds;
- basic technical diagnostics related to the service.
11.2. The Contractor does not warrant that every user issue can be resolved by support, especially if caused by:
- an unsupported app;
- the user’s device;
- external networks;
- third-party actions;
- corporate restrictions;
- non-standard user configurations.
11.3. Any support recommendations are based on information available at the time of the request and are not a guarantee the issue will be resolved in every case.
12. Warranty disclaimer
12.1. Except warranties expressly required by mandatory law, the Contractor gives no further warranties regarding:
- fitness for a particular user purpose;
- full compatibility with the user’s infrastructure;
- absence of technical risks;
- availability of any specific features, servers, routes, or payment methods at all times.
12.2. The Contractor does not warrant that use of the service will necessarily produce the user’s expected outcome in every case.
13. Limitation of liability
13.1. To the maximum extent permitted by applicable law, the Contractor is not liable for:
- indirect damages;
- lost profits;
- data loss;
- loss of business reputation;
- missed opportunities;
- business interruption;
- other indirect consequences of using or being unable to use the service.
13.2. Aggregate liability of the Contractor for user claims related to CredoVPN is limited to the amount actually paid by the user for the relevant paid access period, unless mandatory law provides otherwise.
14. Relationship to other documents
14.1. This Disclaimer applies together with:
- the Public Offer;
- the User Agreement;
- the Service Usage Rules;
- the Privacy Policy;
- the Refund Policy;
- the No-Logs Policy;
- the Subscription Terms;
- other CredoVPN documents.
14.2. If the same matter is governed by several documents, they shall be read together.
14.3. In case of conflict, priority is:
- mandatory provisions of applicable law;
- the Public Offer — for contractual terms;
- special documents — for matters they expressly govern.
15. Changes to this document
15.1. The Contractor may amend this Disclaimer at any time.
15.2. A new version takes effect upon publication unless the text states a different effective date.
15.3. The user shall monitor the current version of the document.
15.4. Continued use after publication of a new version means acceptance of its terms.
